MANTAN Napi Koruptor Bisa Nyaleg Usai 5 Tahun Bebas, KPK Apresiasi Putusan MA
Jakarta, detak24com – Mahkamah Agung (MA) mengabulkan seluruh permohonan uji materi terkait Peraturan Komisi Pemilihan Umum (PKPU) Nomor 10 dan 11 Tahun 2023 perihal kemungkinan mantan terpidana korupsi maju lebih cepat menjadi calon anggota legislatif.
MA memerintahkan KPU mencabut aturan yang memberi karpet merah bagi mantan terpidana korupsi untuk mencalonkan diri sebagai anggota legislatif tersebut. Dalam aturannya, lembaga itu tak mewajibkan masa jeda 5 tahun bagi mantan terpidana kasus korupsi untuk nyaleg.
“Mengabulkan permohonan keberatan hak uji materiil dari para pemohon untuk seluruhnya,” demikian bunyi amar putusan yang disebarluaskan oleh Kabiro Hukum dan Humas MA, Sobandi dikutip dari halloriau menukil Tribunnews, Selasa (03/10/23).
Dengan amar putusan ini maka MA membuyarkan impian para mantan koruptor yang menjadi caleg (calon anggota legislatif) yang akan maju pada Pemilu 2024 nanti.
Uji materi ini dilayangkan oleh Indonesia Corruption Watch, Perkumpulan untuk Pemilu dan Demokrasi (Perludem) serta dua mantan pimpinan KPK yaitu Saut Situmorang dan Abraham Samad. MA menyatakan Pasal 11 ayat (6) PKPU 10/2023 tentang Pencalonan Anggota DPR, DPRD Provinsi, dan DPRD Kabupaten/Kota bertentangan dengan peraturan perundang-undangan yang lebih tinggi, yaitu Pasal 240 ayat (1) huruf g UU No 7/2017 tentang Pemilu jo Putusan Mahkamah Konstitusi (MK) Nomor: 87/PUU-XX/2022 dan karenanya tidak mempunyai kekuatan hukum mengikat dan tidak berlaku umum.
MA juga menyatakan Pasal 18 ayat (2) PKPU 11/2023 tentang Perubahan Kedua Atas PKPU 10/2022 tentang Pencalonan Perseorangan Peserta Pemilu Anggota DPD bertentangan dengan peraturan perundang-undangan yang lebih tinggi, yaitu Pasal 182 huruf g UU No 7/2017 jo Putusan MK Nomor: 12/PUU-XXI/2023 dan karenanya tidak mempunyai kekuatan hukum mengikat dan tidak berlaku umum.
MA menyatakan seluruh pedoman teknis dan pedoman pelaksanaan yang diterbitkan oleh termohon (Ketua KPU RI) sebagai implikasi dari pelaksanaan ketentuan Pasal 11 ayat (6) PKPU 10/2023 dan Pasal 18 ayat (2) PKPU 11/2023 tidak memiliki kekuatan hukum mengikat dan tidak berlaku umum.
“Memerintahkan kepada termohon untuk mencabut Pasal 11 ayat (6) PKPU 10/2023 dan Pasal 18 ayat (2) PKPU 11/2023 serta seluruh pedoman teknis dan pedoman pelaksanaan yang diterbitkan oleh termohon sebagai implikasi dari pelaksanaan ketentuan Pasal 11 ayat (6) PKPU 10/2023 dan Pasal 18 ayat (2) PKPU 11/2023,” kata MA.
MA juga memerintahkan kepada panitera MA untuk mengirimkan petikan putusan ini kepada percetakan negara untuk dicantumkan dalam Berita Negara. “Menghukum termohon untuk membayar biaya perkara sebesar Rp1 juta,” lanjutnya.
Menurut MA, pada prinsipnya penormaan jangka waktu lima tahun setelah terpidana menjalankan masa pidana adalah waktu yang dipandang cukup untuk melakukan introspeksi diri dan beradaptasi dengan masyarakat lingkungannya. Hal tersebut sebagaimana Putusan MK Nomor: 87/PUU-XX/2022 dan Putusan MK Nomor: 12/PUU-XXI/2023. Dengan jangka waktu tersebut, masyarakat dapat menilai calon yang akan dipilihnya secara kritis dan jernih.
