MANTAN Napi Koruptor Bisa Nyaleg Usai 5 Tahun Bebas, KPK Apresiasi Putusan MA
Namun dalam aturannya, KPU justru meniadakan masa jeda 5 tahun bagi eks terpidana kasus korupsi untuk mencalonkan diri sebagai calon legislatif. Dengan berpandangan tindak pidana korupsi sebagai kejahatan luar biasa, terang MA, maka pidana tambahan berupa pencabutan hak politik merupakan penambahan efek jera bagi pelaku kejahatan korupsi. Atas dasar itu, menurut MA, seharusnya KPU menyusun persyaratan yang lebih berat bagi pelaku kejahatan yang dijatuhi pidana pokok dan pidana tambahan berupa pencabutan hak politik.
Berdasarkan alasan tersebut, MA berpendapat objek permohonan keberatan hak uji materiil berupa Pasal 11 ayat (6) PKPU 10/2023 dan Pasal 18 ayat (2) PKPU 11/2023 bertentangan dengan Pasal 240 ayat (1) huruf g dan Pasal 182 huruf g UU 7/2017 tentang Pemilu yang telah ditafsir dengan Putusan MK Nomor: 87/PUU-XX/2022 dan Nomor: 12/PUU-XXI/2023. “Oleh karenanya tidak mempunyai kekuatan hukum mengikat dan tidak berlaku umum,” kata MA.
KPU belum berkomentar terkait putusan MA ini. Sementara ICW mendesak KPU segera merevisi PKPU terkait. “Kami sebagai Pemohon mendesak KPU untuk segera menghentikan kontroversinya dengan mematuhi putusan MA dengan merevisi PKPU 10 dan PKPU 11 Tahun 2023,” ujar peneliti ICW, Kurnia Ramadhana.
Menurut Kurnia, putusan MA ini menunjukkan bahwa aturan yang dibuat KPU bobrok. Aturan KPU justru melanggar ketetapan yang telah dibuat Mahkamah Konstitusi (MK). “Putusan Mahkamah Agung ini memperlihatkan secara terang benderang betapa bobrok dan melanggar hukumnya aturan yang dibuat oleh KPU. Sudah jelas bahwa Mahkamah Konstitusi menetapkan masa jeda waktu bagi mantan terpidana untuk bisa maju sebagai calon anggota legislatif adalah 5 tahun, namun KPU malah mengingkarinya,” kata Kurnia.
KPK Apresiasi Putusan MK
Sementara, Komisi Pemberantasan Korupsi (KPK) mengapresiasi putusan MA itu. Menurut KPK, putusan MA itu selaras dengan semangat pemberantasan korupsi untuk memberikan efek jera bagi para pelakunya. Karena harapannya, pelaku ataupun masyarakat menjadi jera atau takut untuk melakukan korupsi.
“KPK mengapresiasi putusan MA dan ICW (Indonesia Corruption Watch) sebagai pemohon atas judicial review terkait masa jeda mantan narapidana korupsi untuk ikut dalam kontestasi di Pilkada,” kata Juru Bicara KPK Ali Fikri dalam keterangannya, Sabtu (30/9).
Ali menerangkan, dalam histori penanganan perkara oleh KPK, pihaknya seringkali mengenakan tuntutan pidana tambahan berupa pencabutan hak politik kepada terdakwa jika terbukti bersalah melakukan tindak pidana korupsi.
Pidana tambahan pencabutan hak politik merupakan sanksi yang berakibat pada penghilangan hak politik kepada pelaku, yang bertujuan untuk membatasi partisipasi pelaku dalam proses politik, seperti hak memilih atau dipilih, sebagai konsekuensi dari tindak pidana yang dilakukan.
Dikatakan Ali, pencabutan hak politik juga memperlihatkan bahwa dalam tindak pidana korupsi yang pelaku lakukan, telah menyalahgunakan kepercayaan publik. Sehingga, perlu memitigasi risiko serupa dalam pengambilan keputusan politik di masa mendatang oleh mantan narapidana korupsi.
“Namun demikian, penerapan pidana tambahan pencabutan hak politik tetap harus dilakukan dengan berdasar pada prinsip keadilan serta penghormatan terhadap hak asasi manusia,” terangnya, seperti yang dilansir dari tribunnews. ***
